Detailed Information
The owner states that his project was slated to cost approx $160,000.00. What he has failed to explain was the fact that during the course of this project he made so many field changes to a point where he had no choice but to have the project stop until he could hire another architect to show all of the changes. Before the project could start up again he hired a third architect who completly redesigned the structure. All of these changes made the project skyrocket in cost from the original $160,000.00 to a new projected cost of in excess of $400,000.00. Work was started up again after the owner was given the new revised pricing. Since there was a friendship involved the new revised contract was not signed right away. The reason for this delay was because a deal was worked out with this owner for him to provide computer service and business consulting service in exchange for some credit against his project since the cost was raised so much with the changes. Part of the owners responsibility was to have his attorney revamp our contract for his use as well as future customer use. Once his attorney finished up the contract the owner stalled signing it to a point where he was told that without the contract being signed we would have no choice but to stop work. During the entire time working under the original plans all sub contractors and materials were paid for by us. It was only after sub contractors were working on the changes that the owner did not want to pay us for that the sub contractors were told to go directly to the owner for their payments. When we stopped work the true amount of the project had been completed to approx 50%, not the 20% that the owner has stated. In addition the home owner has sent me inflated billings for work that he said performed while acting as my I T company and business advisor. There is clearly a conflict of interest with the owner of this project. |
