Copy of letter sent to Pest Guard on 4/29/08:
Mr. Fletcher
In January 2008, I received a reminder to call your company in order to schedule my annual termite treatment. The reminder requested that payment be sent in prior to the 10th of my service month. On 12 Feb 2008, a check was sent to you in the amount of $225 from my bank. It was deposited and cleared my bank on 19 Feb 2008. On 23 Feb 2008, you treated my home. At that time, you requested an additional $225. I was not at home, and my wife did not know that I had already sent in the payment. She wrote a check, number 1149, in the amount of $225 which was deposited and cleared my bank on 26 Feb 2008.
I called the following Monday morning, 25 Feb 2008, and requested a refund. After several weeks of phone calls, on 9 April, 2008, your secretary told me that she had just gotten a check signed, apologized for the long delay, and promised to have the check in the mail that afternoon. That is the last contact that I have had with your company. I have left several phone messages and have not had my call returned.
This is a demand letter and, regretfully, I will pursue all legal remedies available if I do not receive reimbursement in the amount of $225 within ten days from today. These remedies include reimbursement the initial amount of $225 plus interest, and filing and attorney’s fees. I will also be pursuing remedies under Florida’s unfair and deceptive trade practices act, which provides for treble damages.
I have been very patient with you and your staff up to this point. I am prepared to be in touch with local print and TV media to air my grievances with your company’s inexplicably unprofessional behavior. I look forward to your prompt reply.
